Last Updated: January 19, 2026
1. Introduction
cutbg.cc (the "Operator") operates and manages the website cutbg.cc (the "Platform"), a web-based photo editing application that provides automated background removal services.
Before using any services offered by cutbg.cc, please read these Terms of Service (the "Agreement" or "Terms") carefully. This Agreement is legally binding between the Operator and all users of the Platform (collectively, "Users").
By accessing or using the Platform in any manner—including but not limited to using the services, browsing features or content, or interacting with the application—you agree to be bound by these Terms. These Terms apply to all visitors and users of the website and its services.
2. User Rights
2.1 Permitted Use
Users may access and use the Platform for both personal and commercial purposes, unless explicitly restricted under a specific service plan. However, any output generated through the Platform must comply with applicable laws and must not infringe on third-party rights (including intellectual property or privacy rights).
Note: If your service offers free tiers with non-commercial restrictions, you can adjust this clause accordingly. The current wording assumes commercial use is allowed unless stated otherwise in your pricing plans.
2.2 Right to Restrict Access
The Operator reserves the right, at its sole discretion and without prior notice or liability, to limit, suspend, or terminate a User's access to the Platform for any reason, including violation of these Terms or suspicious activity.
2.3 IP Address Logging
By accessing the Platform, Users consent to the temporary storage of their IP address for the purpose of monitoring usage patterns, ensuring system security, and preventing abuse.
3. User Responsibilities
3.1 Prohibited Conduct
Users agree not to engage in any activity that could impair the functionality, integrity, or security of the Platform. This includes, but is not limited to:
- Scanning, probing, or testing the Platform for vulnerabilities;
- Attempting to bypass security measures;
- Reverse engineering, decompiling, or disassembling any part of the Platform;
- Uploading malicious code, viruses, or other harmful materials;
- Interfering with or disrupting servers or networks connected to the Platform.
3.2 Ownership and Rights to Uploaded Content
Users are solely responsible for ensuring they have the necessary rights, licenses, and permissions to upload, process, and use any image submitted to the Platform. The Operator assumes no liability for copyright, privacy, or other legal claims arising from User-submitted content.
4. Warranties and Limitation of Liability
4.1 No Warranties
The Platform is provided "as is" and "as available," without any express or implied warranties of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
To the fullest extent permitted by law, the Operator disclaims all warranties related to the results, performance, availability, or reliability of the service.
4.2 Limitation of Liability
In no event shall the Operator be liable for any indirect, incidental, special, consequential, or punitive damages—including but not limited to loss of profits, data, or business opportunities—arising out of or in connection with the use of or inability to use the Platform.
The Operator's total liability for any claim related to the Platform shall not exceed the amount paid by the User to the Operator in the six (6) months preceding the event giving rise to the claim.
Nothing in this section excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be lawfully excluded.
5. Confidentiality and Data Protection
All information regarding confidentiality, data handling, and user privacy is governed by our Privacy Policy, which is incorporated herein by reference. Users are encouraged to review the Privacy Policy to understand how their data is collected, used, and protected.
6. General Provisions
6.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the Operator is legally established, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
6.2 Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Operator's place of establishment.
6.3 Amendments
The Operator reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Platform after such changes constitutes acceptance of the revised Terms. For material changes, the Operator may provide additional notice (e.g., via email or site banner).
6.4 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The parties agree to replace any invalid provision with a valid one that reflects the original intent as closely as possible.
